  1. Terms Of Service

    1. SellIt.Online operates a social media-inspired peer-to-peer marketplace which uses artificial intelligence to suggest relevant sellers and items to you and to display your items to the most relevant potential buyers, based on your preferences and other information submitted to it, and which allows you to buy and sell items using the SellIt.Online application which we make available online and for you to download through an app store on your mobile device or via our website (the “Service”). You can search for items, log-in to your profile and view other profiles (each account has a unique and public URL) via the website.

    2. The Service is operated by SellIt.Online, incorporated and registered in Delaware, USA (“we”, "our, or “us”).

  2. Your relationship with us

    1. This document and any documents referred to within it (collectively, the “Terms of Service”) set out the terms of your relationship with us. It is important that you read and understand the Terms of Service before using the Service. If there is anything within them that you do not understand, then please contact us at support@SellIt.Online to discuss what this means for you.

    2. By setting up an account with us and/or using and accessing the Service, you agree to and accept these Terms of Service in their entirety. If you do not agree to these Terms of Service, you may not use the Service.

  3. Information about you and your privacy

    1. Your privacy is important to us. You should read our Privacy Policyto understand how we collect, use and share information about you. You should also read our Cookie Policyto understand how we use cookies within the Service.

  4. Setting up an account

    1. To access our Service, you must register with us and set up an account with a username and password (your “Account”). We encourage you to use “strong” passwords (passwords that use a combination of upper and lower case letters, numbers and symbols) with your Account.

    2. You must be at least 13 years of age and capable in your country of residence of entering into a legally binding agreement to use our Service. SellIt.Online does not knowingly collect or solicit any information from anyone under the age of 13 or knowingly allow such persons to register for the Service. SellIt.Online is a General Audience Site and the Service and its content are not directed at children under the age of 13. Children under the age of 13 are prohibited from providing any personal information to the Site. In the event that we learn that we have collected personal information from a child under age 13 without parental consent, we will delete that information as quickly as possible. You may connect to our Service with third-party services approved by us (e.g., Facebook, Instagram or Twitter) and in such circumstances you give us permission to access and use your information from that service as permitted by that service, and to store your log-in token for that service as set out in our Privacy Policy.

    3. You are responsible for maintaining the confidentiality of your login details and any activities that occur under your Account. If you have any concerns that your Account may have been misused, you should contact us at support@SellIt.Online straight away to let us know.

  5. SellIt.Online Marketplace and Payments

    1. Our Service allows you to buy and sell items in an easy and fun way. You can find out more information about our Service and its features on the main page of the website.

    2. You can sell your items through our Service by publishing pictures of the item you want to sell (“Sale Item”). When a user of the Service purchases such Sale Item, this is a “Sale Transaction”.

    3. Sale Transactions may only take place via either of SellIt.Online’s third party payment providers - PayPal

    4. Where you use PayPal to make or receive payment for a Sale Transaction, you will need a PayPal account to use the Service. If you are under 18 and do not have your own PayPal account, and plan to use a parent’s or third party’s PayPal account, you undertake that you have express permission to use such parent’s or third party’s PayPal account in relation to each and every transaction undertaken on our Service.

    5. To safeguard the interests of our users, you are not permitted to sell or purchase a Sale Item by making direct arrangements with the buyer or the seller to use a payment method other than the payment methods offered via the Service. Please note that selling or purchasing a Sale Item in any other way is a breach of our Rules of Acceptable Use and can result in, among other things, suspension or termination of your access to the Service (See section 7).

    6. We want our Service to be a positive experience for our users and we ask that you honor the commitments you make to another user in respect of the swap, sale or purchase of a Sale Item.

    7. Any agreement for and/or purchase of a Sale Item is made solely between you and the seller. The application may include functionality for suggesting more effective selling, such as discounting Sale Items, but Sellers have, at all times, total discretion to set prices. Complaints, questions and claims related to a Sale Item should be directed to the seller. Where users cannot resolve issues relating to a Sale Transaction between themselves, we will attempt to help mediate such disputes through our dispute resolution process. You can find out more about our dispute resolution procedure at section 14 of these Terms of Service.

    8. As we are not the seller of any Sale Items, we have no control and do not give any commitment relating to the existence, quality, safety, genuineness or legality of Sale Items, the truth or accuracy of any picture or description of the Sale Items or any other content made available by users, the ability of sellers to sell Sale Items, the ability of buyers to pay for them or that a buyer or seller will actually complete a transaction or return the Sale Item, and we have no liability in this respect. Sellers are responsible for ensuring that any age-restricted Sale Items are marked clearly with the applicable age restriction (as required by law) and Buyers agree that they shall not attempt to purchase Sale Items if they are younger than the advertised and legal age restriction.

  6. Your right to use the Service

    1. The intellectual property rights in all materials and content comprising the Service, including but not limited to images, written content and designs on each page of the SellIt.Online application and website, either belong to us or we have permission from the owner to use them to provide the Service. All such intellectual property is protected by worldwide intellectual property laws, including copyright and design laws. We give you permission to use the materials and content comprising the Service for the sole purpose of using the Service in accordance with these Terms of Service.

    2. Your right to use the Service is personal to you and you are not allowed to give this right to another person or to sell, gift or transfer your Account to another person. Your right to use the Service does not stop us from giving other people the right to use the Service.

    3. Other than as allowed in these Terms of Service or by us in writing, you are not given the right to use the “SellIt.Online” name, or any of the “SellIt.Online” trademarks, logos, domain names and other distinctive brand features, all of which are intellectual property rights that belong to SellIt.Online.

    4. These Terms of Service do not grant you any rights to, or in, any such intellectual property rights or any other rights or licenses in respect of SellIt.Online’s materials and content, the Service, SellIt.Online name and/or trademarks, other than as set out in these Terms of Service.

  7. Your content

    1. You confirm that images, sounds, text or information that you submit or create (“User Content”) whilst using the Service will meet the Rules of Acceptable Use.

    2. You grant us a worldwide, non-exclusive, royalty-free, irrevocable and perpetual license to use, copy, reproduce, distribute, adapt, re-format, modify, publish, translate, license, sub-license, assign, transfer and exploit the User Content (including any intellectual property rights therein) anywhere and in any form for the purposes of providing our Service or for any purpose in connection with the operation of our business.

    3. Our right to use your User Content does not in any way affect your privacy rights and we will only use information that identifies you as set out in our Privacy Policy.

    4. We do not check or moderate any User Content before it is added to the Service by users. We may later check, moderate, reject, refuse or delete any User Content if we think that it breaks any of the Rules of Acceptable Use, or we believe it is against the ethos of SellIt.Online.

    5. User Content removed from the Service may continue to be stored by us, including, without limitation, in order to comply with certain legal obligations. Therefore we encourage you to maintain your own backup of your User Content and you agree that you will not rely on the Service for the purposes of User Content backup or storage. To the extent permitted by applicable law, we shall have no liability for any loss of User Content.

  8. Rules of Acceptable Use

    1. In addition to the other requirements within these Terms of Service, this section describes specific rules that apply to your use of the Service (the “Rules of Acceptable Use”).

    2. You must make sure the email address you provide in your Account details remains active and is checked by you on a regular basis.

    3. You are responsible for all taxes (including any associated penalties, fines, charges and late payment interest) relating to your sales of items through our Service. You must comply with all applicable laws in relation to such taxes and shall promptly provide us with any information we require to verify such compliance. To the extent possible under applicable law, you shall reimburse us on demand any costs we incur as a result of your failure to comply with this section 8(3).

    4. When using the Service you must not:

      1. Create more than one Account on the Service (however, you may connect all your social networks or other services accounts, that we support, to your Account on the Service) unless we agree otherwise.

      2. Give any false or misleading information in your Account details.

      3. Permit another person to use the Service under your name or on your behalf unless you are a business and such person is authorized by you.

      4. Use the Service if we have suspended or banned you from using it.

      5. Send junk, spam or repetitive messages.

      6. Engage in any illegal or unlawful conduct including selling or intentionally purchasing any fake or counterfeit items or any item that otherwise breaches another person’s rights, and must comply with applicable legal requirements relating to the sale or purchase of Sale Items (including but not limited to import and export rules and illegal products, the listing of any age restrictions, distance selling and cooling off rights which may apply to a Sale Item where the seller is a business).

      7. Modify, interfere, intercept, disrupt or hack the Service.

      8. Misuse the Service by knowingly introducing viruses, Trojans, worms, logic bombs or other material which would harm the Service or any user of the Service’s own equipment.

      9. Collect any data from the Service other than in accordance with these Terms of Service.

      10. Submit or contribute any User Content (including comments and descriptions relating to Sale Items) that contains unlawful content, nudity or violence, is abusive, bullying, threatening, harassing, obscene, misleading, untrue, offensive, defamatory, derogatory or uses bad or rude language, as SellIt.Online may decide in its absolute discretion.

      11. Unfairly or unlawfully interfere or manipulate any ratings system or user feedback system.

      12. Submit or contribute any User Content without the permission of the content owner, or otherwise infringe the copyright, trademark or other rights of third parties (which includes using hashtags for protected brands, in connection with your listing, that are irrelevant to such listing).

      13. Offer to sell or buy any of the items we list as Prohibited Items - items - SellIt.Online has a zero tolerance policy on using the Service to promote, advertise or sell drugs, drug paraphernalia, tobacco and/or tobacco paraphernalia or related products.

      14. Purchase or sell a Sale Item by making direct arrangements with the buyer or the seller to use a payment method other than PayPal available through the Service.

      15. Take any action which is deliberately designed to circumvent, reduce or manipulate the Commission due to us (as specified in section 11).

      16. Submit or contribute any information or commentary about another person without that person’s permission, or post private or confidential information via the Service, including, without limitation, your or any other person’s credit card information, social security or alternate national identity numbers, non-public phone numbers or non-public email addresses.

      17. Mine data, screen scrape or crawl any part of the Service.

      18. Disassemble, decompile or reverse engineer any part of the Service.

      19. Adapt, copy, vary, edit, distribute or commercialize any content in the Service without the prior written consent of SellIt.Online.

      20. Circumvent any technical measures implemented to protect or provide the Service.

      21. Use any third party’s PayPal account unless you have express permission from them to do so.

      22. Use the service to drop ship

    5. Failure to comply with the Rules of Acceptable Use constitutes a serious breach of these Terms of Service, and may result in our taking all or any of the following actions (with or without notice, and entirely at our discretion):

      1. immediate, temporary or permanent withdrawal of your right to use our Service;

      2. immediate, temporary or permanent removal of any User Content (including the removal of Sale Items listed on the Service);

      3. issuing of a warning to you;

      4. legal action against you including proceedings for reimbursement of all costs (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;

      5. disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

      6. We may investigate any suspected breach of the Rules of Acceptable Use. During such investigation we may temporarily withdraw your right to use our Service or remove User Content (including the removal of Sale Items listed on the Service) without notice to you.

      7. The responses described in section 8.5 are not limited, and we may take any other action we reasonably deem appropriate.

  9. Notice and takedown policy

    1. Any person may contact us by sending us an “Infringement Notice” if any content available through our Service infringes their rights or fails to comply with our Rules of Acceptable Use. The Infringement Notice should be sent either by email to report@SellIt.Online. Please provide the information described below in the Infringement Notice:

      1. your name and contact details;

      2. a statement explaining in sufficient detail why you consider that the content available through our Service infringes your rights or fails to comply with our Rules of Acceptable Use; and

      3. a link to or such other means of identifying the problematic content.

    2. We will take the action that we believe is appropriate depending on the nature of the Infringement Notice and will aim to respond to you within a reasonable period of time on the action we propose to take.

  10. Advertisements on the Service

    1. We and our selected business partners may provide advertising to you through the Service or by other methods such as email. This advertising may be based on your User Content or other information available through the Service. When delivering advertising we will only use information that identifies you as set out in our Privacy Policy. We may use advertising cookies to provide such advertising and you can read our Cookie Policy.

  11. Seller commission

    1. The seller of any Sale Item will pay us a commission on the total transaction amount received by the seller (including VAT and any other applicable taxes, if any, and shipping costs) in respect of any Sale Transaction (the “Commission”). If the Commission payable is less than our minimum Commission, then the seller will be required to pay the minimum Commission. Details of this fee are available on our site.

    2. PayPal may charge you an additional fee and you should ensure you are familiar with PayPal’s terms of use which you will have agreed to when you set up your PayPal account.

    3. Our Commission with be deducted from your PayPal account.

    4. We will provide the seller of the Sale Item with an invoice detailing the Commission.

    5. The Commission is inclusive of VAT or other sales taxes (where applicable).

  12. Ending our relationship

    1. If at any time you decide you can no longer agree to these Terms of Service or any changes made to the Terms of Service or the Service, you must immediately stop using the Service.

    2. If you wish to end your use of the Service, please contact us at close@SellIt.Online from the email address linked to your account and ask us to deactivate your Account. Where such request comes from someone who is not the account holder, we may ask you to provide proof of who you are and your relationship to the User in question, and any other documents we may reasonable require.

    3. We may immediately end your use of the Service if you break the Rules of Acceptable Use, any other important rule(s), or terms and conditions we set for accessing and using the Service including these Terms of Service.

    4. We may also withdraw the Service for any reason, without notice, at any time and without any liability to you.

    5. If you or we end your use of the Service or we withdraw the Service as described in this clause, we may delete or modify your User Content, Account or any other information we hold about you. You will also lose any rights you have to use the Service or access our content or your User Content. We will not offer you compensation for any losses. You should note that even if your Account is deactivated, some of your data may persist and appear within the Service, for example where your User Content has been re-shared by others.

  13. Our liability/responsibility to you

    1. You alone decide whether to proceed with a sale or purchase of a Sale Item. As such, we make no commitments regarding the Sale Items including the quality or delivery of the Sale Items, or for honoring (or causing any seller to honor) any erroneous information regarding the price, description and availability of, or any information relating to any Sale Items promoted or available through our Service, or the ability of the buyer to complete any purchase of the Sale Items.

    2. Although it is our intention that the Service is available as much as possible, there may be occasions when the Service may be interrupted, including for scheduled maintenance, upgrades and emergency repairs, or due to failure of telecommunication links and/or equipment. The Service and any content contained therein (including User Content) is provided on an “as available” and “as is” basis. This means that we are unable to promise that your use of the Service will be uninterrupted, without delays, error-free or meet your expectations and we do not give any commitment relating to the performance or availability of the Service in these Terms of Service and, to the extent we are able to do so, we exclude any commitments that may be implied by, or be expressed by, applicable law. You accept that the internet may be subject to breaches of security and that the submission of User Content or other information may not be secure.

    3. SellIt.Online is not responsible or liable for any loss or harm caused by viruses, worms or other programs designed to impair the Service.

    4. You may be able to access third party links/websites/products via the Service. SellIt.Online is not responsible or liable for any third party links/websites/products which may be accessed by you at your sole option. Your access to and use of such third party links/websites/products and services shall be solely at your own risk and subject to your acceptance and compliance with the separate terms and conditions of such third party.

    5. To the maximum extent permitted by the law, our total responsibility for any claims relating to a Sale Transaction is limited to the Commission payable in connection with that Sale Transaction.

    6. For any other claims arising out of the provision of the Service (including without limitation any dispute between users where this does not fall within paragraph 5 above, in relation to any content you access via the Service, or any other user you interact with), we do not accept any responsibility whatsoever (whether arising in contract, tort otherwise), except where we cannot disclaim, exclude or limit responsibility by law (such as death and/or personal injury caused by our negligence).

    7. We will never be responsible for any loss or damage that is not reasonably foreseeable and we will never be responsible for indirect losses and/or financial and business loss, or loss of goodwill or reputation.

  14. Your responsibility to us

    1. If SellIt.Online is sued due to an action or inaction by you (including a breach of these Terms of Service) then we have the right, at our discretion, to request that you indemnify us (i.e. cover all our costs including legal fees) and hold us harmless from any legal claim or demand for expenses or costs that arises as a result. Where we decide to conduct the defense of such claim, you agree to assist us as reasonably requested.

  15. Resolving disputes

    1. Disputes with us

      1. If you have a dispute with us relating to the Service, in the first instance please contact us at support@SellIt.Online and attempt to resolve the dispute with us informally.

    2. Disputes with other users relating to a Sale Transaction

      1. General

        1. If you use PayPal for a Sale Item or receive any money for a Sale Transaction you may be eligible for Buyer or Seller Protection, details of which are available below.

        2. All purchases/sales made outside of SellIt.Online are against our Terms of Service and are not covered by Buyer or Seller Protection.

        3. If:
          a) as a buyer your Sales Item has not arrived, or if what you received is significantly not as described or faulty, or
          b) as a seller you are sent an unauthorized payment, or a buyer claims they didn’t receive their Sale Item, you can report the issue to us within 180 days and we will reply to you with instructions on how to proceed. Please make sure you report the issue as set out in paragraph 8 below in order to guarantee a prompt reply. To open a dispute: Open the app and go to Profile > Support > Help > Report a transaction problem > select ‘Purchased Items’ and find the transaction you want to report.

        4. Please know that in regards to any kind of buyer or seller protection, we can only accept tracking codes as valid proof of delivery (a tracking code that can be verified online - this does not include Royal Mail reference numbers unless this records actual delivery), and that the cost of returning the Sales Item cannot be refunded. 

      2. Transactions via PayPal - Buyer and Seller Protection:

        1. In order to be eligible for PayPal Buyer or Seller Protection, you must: a) purchase/sell the Sale Item in-app using PayPal, and b) report the transaction issue to PayPal within 180 days from the date of purchase/sale. Buyer or Seller Protection applies only if these conditions are met. non-material goods, prohibited items and meet-in-person transactions are not covered by PayPal Buyer or Seller Protection.

        2. If PayPal verify that the Sales Item was not received or was significantly not as described, you may be entitled to a refund under Buyer Protection. If the Sales Item is significantly not as described, PayPal will ask you to return it to the seller before refunding you. If the Sales Item is found to be counterfeit, PayPal will ask you to destroy it.

        3. Sellers using PayPal: If PayPal verifies the circumstances of your claim, then you may be covered for the amount of the Sale Item on eligible sales.

        4. PayPal’s investigation of disputes is subject to the PayPal Terms of Service to which you will have agreed when setting up your PayPal account, so you should check these.

        5. Where Buyer and Seller cannot agree resolution, SellIt.Online will try to mediate a resolution between you and the Buyer. If we find that the Buyer was correct in that the Sale Item was not as described or was not delivered, subject to the Buyer returning the item to you, you agree to refund the full sale price of the Sale Item and where you fail to do so, you hereby give SellIt.Online permission to do so on your behalf.

        6. If a chargeback is raised against you as Seller, SellIt.Online will ask you to provide evidence of shipping and that the Sale Item was as described in the original listing, within 3 calendar days. If you do not respond within the timeframe and/or we believe the Buyer to have validly initiated the chargeback, we will activate a refund for the Buyer of the value of the Sale Item in question and a $30.00 USD chargeback fine will be deducted from your SellIt.Online Payment account. If Buyers are making regular chargebacks from you as a Seller, then we may investigate your account and your compliance with these terms of service. This may result in suspension of your account.

        7. Should you decide to appeal any decision SellIt.Online has made under this section of the terms, then please contact us. Be aware that we will only consider appeals where you can supply new evidence to support your case.

  16. Shipping

    1. The seller is responsible for the shipment of the Sales Item to the buyer.

    2. Sellers in the United States who have an active PayPal Billing Agreement with SellIt.Online are able to use our “Ship with USPS” or “Shipstation” as an option to easily calculate and charge for shipping, download a shipping label and track their package all in app.

    3. The “Ship with USPS” option is currently only available for domestic shipping within the U.S.

    4. If the seller chooses to use the “Ship with USPS” when listing a product the Seller agrees to pay SellIt.Online the applicable “Shipping Fee”. Both the Commission and the Shipping Fee will be deducted from your PayPal account.

    5. A seller may request a refund for unused postage via email to SellIt.Online Community Support. Any refund is subject to the policies of the applicable Courier. If the Courier refuses to issue a refund, SellIt.Online is not liable for any postage amounts paid to such Courier. If a refund is issued, it will be provided no earlier than 7 days after the order date. Any postage or fee refund claims must be filed within 30 days after the label has been issued.

    6. SellIt.Online shall not be responsible for any local customs charges, import taxes or duties or any similar charge(s) incurred through the carriage and/or delivery of any shipments and the seller must satisfy themselves as to whether any of these charges will become due, and if so in what amounts. If any such charges become due as a result of carriage and/or delivery of a shipment and are charged to SellIt.Online by any competent authority the seller agrees to reimburse SellIt.Online fully in respect of the same within 7 days of our demand.

  17. Changes to the Service

    1. We are constantly updating and improving the Service to try and find ways to provide you with new and innovative features and services. Improvements and updates are also made to reflect changing technologies, tastes, behaviors and the way people use the Internet and our Service.

    2. In order to do this, we may need to update, reset, stop offering and/or supporting a particular part of the Service, or feature relating to the Service “changes to the Service”. These changes to the Service may affect your past activities on the Service, features that you use and your User Content “Service Elements”. Any changes to the Service could involve Service Elements being deleted or reset.

    3. You agree that a key characteristic of our Service is that changes to the Service will take place over time and this is an important basis on which we grant you access to the Service. Once we have made changes to the Service, your continued use of the Service will show that you have accepted any changes to the Service. You are always free to stop using the Service or deactivate your Account by contacting us at close@SellIt.Online from the email address linked to your account.

  18. Changes to these Terms of Service

    1. We may revise these Terms of Service from time to time and any changes will take effect after 3 days of any notification email sent to you notifying you of any changes, or at the time the revised Terms of Service are posted (whichever is the earlier) and your continued use of the Service shall constitute acceptance of such revised Terms of Service.

    2. Changes will usually occur because of new features being added to the Service, changes in the law or where we need to clarify our position on something.

    3. We will try, where possible and reasonable, to contact you to let you know about any significant changes to any of the documents referred to in these Terms of Service. We may contact you through the Service (for example by asking you to accept the changes before you continue to use the Service) or via a separate email.

    4. Normally, we will try to give you some warning before the new terms become effective. However, sometimes changes will need to be made immediately and if this happens we will not give you any notice.

  19. Documents that apply to our relationship with you

    1. The current version of the Terms of Service contains the only terms and conditions that apply to our relationship with you. Older versions of the Terms of Service will no longer apply to our relationship and will be completely replaced by the current version.

    2. We intend to rely on these Terms of Service as setting out the written terms of our agreement with you for the provision of the Service. If part of the Terms of Service cannot be enforced then the remainder of the Terms of Service will still apply to our relationship.

    3. If you do not comply with these Terms of Service and we do not take action immediately, this does not mean we have given up any right we have and we may still take action in the future.

  20. Law and general provisions

    1. As we are based in the United States, United States law will apply to all disputes and the interpretation of these Terms of Service. The courts will have non-exclusive jurisdiction over any dispute arising from or related to your use of the Service. These Terms of Service do not exclude any mandatory legal rights you may have or obligations SellIt.Online may have in your country of residence, where SellIt.Online is not allowed to exclude such as a matter of law.

    2. We may assign any of our rights and obligations under these Terms of Service.

    3. These Terms of Service do not create an agency, partnership, employment or joint venture relationship between you and SellIt.Online.

    4. SellIt.Online will not be liable for any delay in performing or failure to perform its obligations caused by any force majeure event. In those circumstances SellIt.Online will be granted a reasonable extension of time for the performance of its obligations, the reasonableness of that extension to be assessed in the context of these Terms of Service and SellIt.Online’s other commitments.

    5. No third party or (except, where applicable, the permitted assign of SellIt.Online) is entitled to the benefit of these Terms of Service under the Contracts (Rights of Third Parties) Act 1999 or otherwise.

    2. We value hearing from our users, and are always interested in learning about ways we can improve the Service. By providing your feedback you agree that you are giving up any rights you have in your feedback so that we may use and allow others to use it without any restriction and without any payment to you.

The SellIt.Online app (“App”) and website (“Site”) are run by SellIt.Online. We are committed to protecting and respecting your privacy.

SellIt.Online provides a social media-inspired peer-to-peer marketplace which uses artificial intelligence to suggest relevant sellers and items and to display items to the most relevant potential buyers based on user preferences and other information submitted to it, which you can access via the App and through our website (“Service”). You can search for items, log-in to your profile and view other profiles (each shop has a unique and public URL) via the website. The above information will also be visible to search engines, including but not limited to the photos that you post. When you use our Site or Service we will collect and process certain information about you. Payment and transaction information:
We keep records of the products you buy, sell or exchange though the Service and the payment method you use for the transaction. We will use payment and transaction information to assist in the payment process for any product you purchase through the Service. We will use your payment and transaction information and history to determine products and services that may be of interest to you and send you marketing. We will provide your contact details to the seller of any item you purchase including your username and the name, delivery address, email address and phone number you provide at the checkout.

Information provided by social networks you connect or link to our Service:
If you choose to connect an account on a social network, such as Facebook, Twitter or Instagram to your SellIt.Online account you are consenting to us collecting personal information from the social network in accordance with your privacy settings on that social network. The connected social network may provide us with information such as your name, Facebook id, Twitter handle, profile picture, gender, username, user ID, age or age range, language, country, friends list, follower list and any other information you have agreed it can share. We will use the personal information provided to help create a public profile for you on our Service and, where we provide the functionality, we will also use the information provided to assist you in sharing your experiences on our Service with your friends, followers or contacts on the connected social network. We may also use the connection between the social network and our Service to provide you with updates on the social network that are relevant to any account you have with us or promotion you are taking part in. Such updates will only be provided with your consent. We will not post to your social network or to your friends, followers or contacts without your consent.

Your relationships with other users:
We may collect information regarding other users that you are following on our Service which we use to prioritize items displayed to you in your search results or your timeline based on SellIt.Online’s internal algorithm and to determine other products and services that may be of interest to you. We also store information regarding any blocked or banned relationships associated with your account in the legitimate interests of enforcing our Terms of Service and managing user preferences regarding who they wish to communicate with on our Service.

Website and app login details:
Where you create an account with us we will hold your user name and password details in the legitimate interests of keeping your account secure. Where you are provided with the option to log-in using a social network, for example through Facebook sign- in, we will not be provided with your password or other account login details for those accounts.

You are responsible for all actions taken with your user name and password, and we recommend that you do not disclose your user name and password to any third parties. If you lose control of your password, you may lose substantial control over your personally identifiable information and may be subject to legally binding actions taken on your behalf, so you should change such password immediately and notify us of any unauthorized access to your account.

Your preferences:
We hold information about the preferences you set for notifications, marketing communications and how our site is displayed or what content is displayed to you through our Service. We will use your preference settings for the purpose of providing notifications, sending marketing communications and displaying our Service in accordance with your choices.

where you allow us to in your operating system settings, we will send you notifications relating to the Service.

You can change your push notification preferences at any time in your account settings.

Where you have given us permission to do so, we may share your information with selected third parties so that they can provide you with information about their products and services using email.

If, after you have given us permission to share your email address with selected third parties, you change your mind, you can change your email marketing preferences by emailing us at support@SellIt.Online and letting us know that you do not want us to share your email address with third parties for marketing purposes.

Advertising on the Service and third party websites

The Service is designed to help you interact with other users of the Service. As a result of this some of the information generated through the Service is shared with other users of the Service as described below.

  1. User profile

    When you create an account on the Service a user profile will be generated for you that makes the following information publicly available: user name, country and city location, your followers and who you are following, details about the items you are selling. If you add any of the following information to your profile this will also be made publicly available: profile picture, profile description and website address. We will not directly reveal user email addresses to other users, however we may pass your email address to a seller where you have purchased an item.

  2. Item listings

    When you list an item for sale on the Service information you add to the listing will be made publicly available such as the item photograph, price, item description, accepted payment method and delivery options. Any comments or likes other users add to your item listing will also be made publicly available as well as any reply comments or images you post. Other users may also share a link to an item they have bought from you via the Service on other social media channels which link to the Service, but this will not result in any information that was not already public, being made public.

  3. Information about your activity on the Service

    Some of your activities on the Services are public by default. These activities are when you follow a user, or a user follows you, when you comment on or like an item, when you list an item for sale, when your item is sold, or when you purchase an item.

  4. Social networks you connect to the Service

    Where you have chosen to do so we will post updates about your use of the Service to social networks you connect to the Service on your behalf.

Information we share with third parties

We may share your personal information with the following parties:

Companies in the same group of companies as us – our subsidiaries (i.e. any organization we own or control) or our ultimate holding company (i.e. any organization that owns or controls us) and any subsidiaries it owns. These companies will only use your personal information in the same way as we can under this Privacy Policy.

Information that cannot identify you

We do not disclose information about identifiable individuals to anyone else except as set out in this Privacy Policy and subject to applicable data protection legislation. We may provide third parties with aggregate statistical information and analytics about users of the Service but we will make sure that no one can be identified from this information before we disclose it.

Storing and transferring your personal information

We will consider any such objection, however in some cases we may demonstrate that our legitimate grounds override your rights and freedoms.     If you do not want us to conduct behavioral analytics for the purposes of SellIt.Online’s internal algorithm used to display relevant sellers and items to you or to display your items to the most relevant potential buyers, you must close your SellIt.Online account and cease using our Service. This is because it is essential to SellIt.Online to suggest the right items and sellers to you and to display your items to the right buyers which we can only do by learning about your tastes and preferences and the types of products you list.

    To exercise any of the above rights, or if you have any questions relating to your rights, please contact us by using the details set out in the “Contacting us” section below. We may need to request specific information from you when you exercise your rights to confirm your identity and to speed up our response. We may not be able to fulfil your request if we are not able to identify you.

    Most of the personal information we hold about you is either available directly from viewing your account and looking back over your own activities or is available from the social networks that you have connected to our Service. If you think that there is other personal information which you think we hold, please contact us using the contact details set out in the “Contacting us” section below. Please provide as much information as you can about the personal information you are looking for and we will be happy to try and help you find it.

Our policy towards children

SellIt.Online is a General Audience Site and our Service is only available to persons aged 13 and over.

The Service is not directed to persons under 13 and we do not knowingly collect personal information from children under 13. Children under 13 years of age are prohibited from providing any personal information to the Site. If you become aware that your child has provided us with personal information without your consent, then please contact us using the details below so that we can take steps to remove such information and terminate the child’s account.

Your California Privacy Rights

Pursuant to California’s “Shine The Light law (California Statute § 1798.983), California residents are entitled, once a year and free of charge, to request the disclosure of certain categories of personal information to third parties for their own direct marketing purposes in the preceding calendar year, if any. For California residents under the age of 18 and registered users of our App or Site, California law (Business and Professionals Code § 22581) provides that you can request the removal of content or information you posted on the App or Site. Any such request should be sent to us at data@SellIt.Online along with a description of the posted content or other information to be removed. Be advised, however, that applicable law may not permit us to completely or comprehensively remove your deleted content or for other reasons as set forth in this California law.

California Consumer Privacy Act 

The California Consumer Privacy Act (CCPA), effective January 1, 2020, gives California consumers enhanced rights with respect to their personal information that is collected by businesses. First, California consumers may opt out of having their personal information sold to other persons or parties. Second, they have a right to know:

  1. What specific pieces of information a business has about the consumer;

  2. Categories of personal information it has collected about the consumer;

  3. Categories of sources from which the personal information is collected;

  4. Categories of personal information that the business sold or disclosed for a business purpose about the consumer;

  5. Categories of third parties to whom the personal information was sold or disclosed for a business purpose; and

  6. The business or commercial purpose for collecting or selling personal information.

In addition, California consumers can request that the personal information a business has collected about them be deleted from the business’s systems and records.

SellIt.Online is a covered business under the CCPA as it collects and processes the personal information of California consumers. This Privacy Policy provides the required notices to California consumers. 

SellIt.Online does not presently sell any personal information to third parties for any purpose. 

To make a “request to know” or request to delete your personal information, send us an e-mail at data@SellIt.Online. (Please put either “Request to Know” or “Request to Delete” in the subject heading of your email.) You may also submit these requests via Email.

We will honor these requests for US individuals whether or not you would qualify as a California consumer under the CCPA.

We will confirm receipt of your request within 10 days along with a description of what steps we will take to verify and respond. We must provide the requested information or delete your personal information within 45 days of receipt of your request but can use an additional 45 days, but we must let you know the additional time is needed.

When contacting us, we may ask you to provide certain, limited personal information, such as your name, email address and/or username to verify your request and to match with our records and systems. This is to protect against fraud. We will not retain this personal information or use it for any other purpose. And we need to search our records and systems only for the preceding 12 months.

Do Not Track 

We currently do not honor browser-based Do-Not-Track signals.

Changes to this policy

We may amend this Privacy Policy from time to time in order that it accurately reflects the regulatory environment and our own data collection and disclosure practices. Accordingly you should review this policy periodically. When we change this Privacy Policy in a material way, we will update the “last modified” date at the top of this Privacy Policy.     Content that breaches on the intellectual property rights of third parties can be removed without notice.

    Copyright content includes, but is not limited to; artworks, photography, film, music, novels, music.

    • Only list content you own on SellIt.Online. Don’t use photographs from other SellIt.Online users, online stores, catalogues, e-commerce sites, third party suppliers, social media sites, or other sources. 

    • Don’t sell unauthorized copies of texts, artwork, music, workout guides, films, or any other content that you don’t have permission to replicate. 

  3. Trademark

    Trademarked content includes, but is not limited to; brand names, company names, logos, branded products, services.

    Only use trademarks to describe products you are selling if they are made by the owner of that trademark. Don’t use brand logos to make custom products, or mention brand names or trademarks in your listings. 

  4. Protected Designs

    Protected (also known as patented) designs are novel and unique clothing & accessory designs that have been granted special protection from imitation.

  5. Protecting your content

    If you are the copyright or trademark owner, or authorized to act on the owner’s behalf, you can report content that breaches your intellectual property rights to us at report@SellIt.Online with the subject line “Infringement Notice”. Please include direct web links to listings from the websitewith any supporting documents.

    We may request proof of IP ownership or authorization by the owner before content is removed.

  1. What about fees?

    • When you sell an item, SellIt.Online will automatically charge the 6% fee on the total transaction amount (including shipping costs). This charge will be taken directly from your PayPal account or the card you are using for payments before the remainder of the money you have made is paid to you.

  2. Fee Breakdown:

    • 10% SellIt.Online fee

    • PayPal transaction fee of 2.9% + $0.30 in the USA and 2.9% + £0.30 in the UK

    • If you are in the USA and have added shipping, this amount will also be taken.

  3. Why does SellIt.Online charge 6%?

    • The 6% fee is in place to keep the app up and running, with general up-keep costs and to pay all of our employees, from engineers, to design, to our product team, and to us in the Support team that are writing this very article!

    • Unlike many other selling platforms, at SellIt.Online only charge you when you make a sale, this means there are no fees for the length of time your item has been listed for or any initial costs to list the item, so list to your heart’s content because it’s all free!

This list of prohibited and restricted items is not exhaustive, and is intended only as a guide. In addition, you may only sell items in your possession and you may not buy or sell items if legally prohibited in your Country of residence even if listed as allowed below.

We reserve the right to determine what items are or are not allowed to be listed on our website and app at any time.     Animal traps including glue-based traps used in pest control to catch and monitor insects

    Narcotics, steroids, and any other controlled substance

    Any substance described as having drug-like effects (for example, a 'legal high')

    Any article meant for the use, manufacturing or concealing of a controlled substance

    We have a zero tolerance policy for any drugs, drug paraphernalia, tobacco or smoking accessories and will take immediate action on any item in this category found on SellIt.Online


    Perishable or past expiration date food and edible items

    Non-perishable food and edible items that do not have a clear expiry date

    Home caterer services

    The sale of the following is allowed:

    1. Non-perishable food and edible items that have a clearly marked expiration date shown in the listing. The item must comply with applicable food regulations at the time of the sale both in the country where SellIt.Online is located and in the registered user’s country of residence and/or domicile


    Any firearms, weapons and military items, regardless of their functionality, construction date or of their being collectibles. The term 'firearm' indicates all the parts constituting a firearm, a sporting gun, alltypes of collectible, vintage, antique and signaling guns

    Any used clothing item made available for sale in breach our Terms of Service or this List. The seller must declare that the article is not new and that it has been cleaned according to the manufacturer’s instructions.
